Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Share Music website (sharemusic.cc), the What's Playing Bot, and the What's Playing Bot Telegram Mini App (collectively, the "Service") operated by us ("us", "we", "our", or the "Company").

Your access to and use of the Service is conditioned upon Your acceptance of and compliance with these Terms. By accessing or using the Service in any manner, You agree to be bound by these Terms. If You disagree with any part of the Terms, then You do not have permission to access the Service.

1. Description of Service

The Service is a Telegram-based tool and Mini App that allows users to share music currently playing on third-party streaming platforms, generate universal music links across multiple services, and control playback within Telegram. The Service acts solely as an interface and link generator; it does not host, store, or distribute any audio content, music files, or copyrighted material.

2. Eligibility

You must be at least 13 years of age (or the minimum legal age in Your jurisdiction) to use the Service. By using the Service, You represent and warrant that You meet this age requirement and have the legal capacity to enter into these Terms.

3. Accounts and Third-Party Authorization

To access certain features of the Service, You must authorize the Service through third-party platforms using official OAuth 2.0 protocols.

• No Password Storage: We do not collect, store, or have access to Your passwords for any third-party platform.
• User Responsibility: You are solely responsible for maintaining the confidentiality of Your accounts and for all activities that occur under Your accounts on third-party platforms.
• Compliance with Third-Party Terms: Your use of the Service is also subject to the terms of service and privacy policies of the third-party platforms You authorize. In the event of a conflict, the terms of the third-party platform shall prevail with respect to Your use of that platform.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You agree NOT to:

• Use the Service in any way that violates any applicable law or regulation.
• Attempt to gain unauthorized access to, interfere with, disrupt, or compromise the integrity or security of the Service.
• Use the Service to distribute malware, spam, or any other malicious material.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
• Use the Service to infringe upon the intellectual property rights of others.

We reserve the right to suspend or terminate Your access to the Service immediately, without notice, if You violate any of these restrictions.

5. Intellectual Property and Copyright

Third-Party Content: All music, album artwork, track metadata, and related content accessed through the Service is the property of the respective rights holders. The Service does not claim any ownership over such content. We merely provide links and references to content hosted and controlled by third-party platforms.

Service Content: The Service itself, including its design, layout, and original content, is owned by the Company and protected by intellectual property laws.

6. Payments and Subscriptions (If Applicable)

Certain features of the Service may be offered on a paid basis. If You choose to purchase Paid Features:

• All payments are processed through third-party payment providers. We do not store Your credit card numbers or sensitive financial information.
• All fees are non-refundable unless otherwise required by applicable law or explicitly stated in a separate refund policy.
• We reserve the right to change the pricing of Paid Features at any time.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that third-party APIs will remain available or unchanged.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS OPERATORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
• (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
• (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND
• (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL UNDER NO CIRCUMSTANCES EXCEED THE NOMINAL AMOUNT OF ONE US DOLLAR (USD $1).

YOU EXPRESSLY ACKNOWLEDGE THAT YOU USE THE SERVICE AT YOUR SOLE RISK.

9. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its operators from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from Your use of the Service, Your violation of these Terms, or Your violation of any rights of a third party.

10. Termination

We may terminate or suspend Your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms.

11. Governing Law

These Terms shall be governed and construed in accordance with applicable laws, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of the jurisdiction where the Company operates, as determined by applicable law.

12. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after any revisions become effective, You agree to be bound by the revised terms.
